Overview

Welcome to Archandles. The terms "we", "us", and "our" refer to Archandles. Archandles operates this store and website at archandles.com, including all related information, content, features, tools, products, and services (the "Services") to provide you with a curated shopping experience. The Services are powered by Shopify, which enables us to provide them to you.

These Terms of Service, together with any policies referenced (the "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about your legal rights and cover topics such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

Section 1 — Eligibility and account

By agreeing to these Terms, you represent that you are at least 18 years of age (or the age of majority in your state, province, or country of residence, whichever is greater), and you have given consent to allow any minor dependents in your household to use the Services on devices you own or manage.

To use the Services — including browsing the store or placing an order — you may be asked to provide information such as your email address, billing address, payment, and shipping details. You represent that all information you provide is accurate, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 — Our products

We make every effort to accurately represent our products, including finishes, materials, dimensions, and weights. However, please note:

  • Colors, finishes, and surface textures may differ from how they appear on your screen due to your device type, screen calibration, and lighting conditions
  • Solid brass, bronze, and other natural-finish products will develop a unique patina over time, which is a feature of the material rather than a defect
  • Wood components (walnut, oak, beech) have natural grain variation; no two pieces are identical

We do not warrant that the appearance of any product will exactly match how it is depicted in the Services.

All product descriptions, specifications, and prices are subject to change at any time at our sole discretion. We reserve the right to discontinue any product or limit quantities offered to any person, geographic region, or jurisdiction on a case-by-case basis.

Section 3 — Orders

When you place an order, you are making an offer to purchase. Archandles reserves the right to accept or decline any order at our sole discretion. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting. Order changes or cancellations may not be possible once we begin processing — most orders ship within 1–2 business days. If we are unable to accept, modify, or cancel your order, we will attempt to notify you using the contact information provided at checkout.

Returns and exchanges are governed by our Refund Policy.

You represent and warrant that your purchases are for your own personal, household, or professional design use, and not for unauthorized commercial resale or export. Trade Program members are subject to additional terms (see Section 8).

Section 4 — Pricing and billing

Prices, discounts, and promotions are subject to change without notice. The price you pay is the price in effect at the time your order is placed, as shown in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, handling, customs, or import charges.

Prices in our online store may differ from those offered in third-party stores or marketplaces.

In the event of an obvious pricing error (such as a product listed at a clearly incorrect price), we reserve the right to cancel the affected orders and issue a full refund, even if the order has been confirmed and payment has been processed.

You agree to provide accurate purchase, payment, and account information for all transactions, and to keep your account details current.

You represent that:

  1. The payment information you provide is true, correct, and complete
  2. You are duly authorized to use the payment method
  3. Charges incurred will be honored by your card issuer or payment provider
  4. You will pay all charges at posted prices, including shipping, handling, and applicable taxes

Section 5 — Shipping and delivery

Shipping terms are described in our Shipping Policy. In summary:

  • All delivery times are estimates only and are not guaranteed
  • We are not liable for delays caused by shipping carriers, customs processing, weather, or other events outside our control
  • Once we hand off products to the carrier, title and risk of loss transfer to you, except where prohibited by applicable consumer protection law

For damaged or lost shipments, please refer to our Refund Policy for the claims process.

Section 6 — Returns and refunds

All returns, exchanges, and refunds are governed by our Refund Policy. Please review it before placing an order. Key points:

  • 30-day return window from delivery
  • Items must be unused, uninstalled, and in original packaging
  • Custom finishes, made-to-order pieces, samples, and certain bulk orders are non-returnable
  • Damaged or defective items must be reported within 7 days of delivery

Section 7 — Warranty

Archandles products are covered by a Limited Warranty against manufacturing defects. The full warranty terms, including duration, coverage, and exclusions, are available on request — please email hello@archandles.com with subject line "Warranty" and we will send the current warranty document.

The Limited Warranty does not affect any non-excludable rights you may have under the consumer protection laws of your jurisdiction, including the Australian Consumer Law, the U.S. Magnuson-Moss Warranty Act, and applicable state-level consumer protection laws.

Section 8 — Trade Program

Archandles offers a Trade Program for interior designers, architects, builders, and other qualified professionals. Trade Program members are subject to additional terms set out in the Trade Program agreement at the time of approval, which may include:

  • Project pricing and volume discounts
  • Extended payment terms
  • Custom finish and made-to-order options
  • Lead-time commitments and bulk fulfillment
  • Modified return and restocking policies (see Refund Policy, Trade Program section)

If there is any conflict between these Terms and the Trade Program agreement with respect to trade transactions, the Trade Program agreement controls. Approval to the Trade Program is at our sole discretion.

Section 9 — Intellectual property

The Services — including all trademarks, brands, text, displays, images, graphics, product reviews, photography, video, audio, product designs, and the selection and arrangement thereof — are owned by Archandles, our affiliates, or our licensors and are protected by Australian, U.S., and international intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works, publicly display, republish, download, store, or transmit any of the material on the Services without our prior written consent.

Except as expressly provided, nothing in these Terms grants any license or rights to you under any patent, trademark, copyright, or other intellectual property of Archandles, Shopify, or any third party. All rights not expressly granted are reserved.

"Archandles" and our product names, designs, and slogans are trademarks of Archandles. You must not use any of these without our prior written permission. Shopify's name, logo, and product names are trademarks of Shopify. All other trademarks belong to their respective owners.

Section 10 — Optional tools

You may be provided access to third-party customer tools as part of the Services, which we neither monitor nor control. You acknowledge and agree that such tools are provided "as is" and "as available" without warranties of any kind. We have no liability arising from your use of optional third-party tools.

Use of any optional third-party tools is at your own risk. You should review and accept the terms of each third-party provider before using their tools.

We may introduce new features, tools, and resources to the Services in the future. Such additions are also subject to these Terms.

Section 11 — Third-party links

The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating the content, accuracy, or practices of those sites. If you choose to leave the Services to access third-party content, you do so at your own risk.

We are not liable for any harm or damages related to your use of third-party websites or your purchase of products or services from third parties. Please review the privacy and terms of each third-party site before engaging with them.

Section 12 — Relationship with Shopify

The following section accurately characterizes Shopify's relationship with our store and is required by Shopify's merchant terms.

Archandles is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases through our store are made directly with Archandles. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Archandles, including any injury, damage, or loss resulting from purchased products or services. You hereby release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with Archandles.

Section 13 — Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy, and certain information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read both policies.

Because the Services are hosted by Shopify, Shopify collects and processes information about your access to and use of the Services. Information you submit may be transmitted to and shared with Shopify and third parties located in countries other than where you reside. See our Privacy Policy for full details.

Section 14 — Feedback

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, photographs, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use such as marketing and product development.

You represent and warrant that:

  1. You own or have all necessary rights to the Feedback you submit
  2. You have disclosed any compensation or incentives received in connection with your Feedback
  3. Your Feedback complies with these Terms

We have no obligation to: (a) keep your Feedback in confidence; (b) compensate you for your Feedback; or (c) respond to your Feedback.

We may, but are not required to, monitor, edit, or remove Feedback we determine to be unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that violates anyone's intellectual property or these Terms.

You agree your Feedback will not violate any third-party rights — including copyright, trademark, privacy, or personality rights — and will not contain unlawful, abusive, or obscene content, or any malware. You may not impersonate another person or misrepresent the origin of your Feedback. You are solely responsible for your Feedback.

Section 15 — Errors, inaccuracies, and omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, and availability. We reserve the right to correct any errors, update information, or cancel orders if any information is inaccurate at any time, including after an order has been submitted.

Section 16 — Prohibited uses

You may access and use the Services only for lawful purposes. You may not use the Services, directly or indirectly:

  • For any unlawful or malicious purpose
  • To violate any international, federal, state, provincial, or local laws or regulations
  • To infringe our intellectual property rights or those of others
  • To harass, abuse, harm, defame, or intimidate any person, including our employees
  • To transmit false or misleading information
  • To send spam, junk mail, or unsolicited promotional material
  • To impersonate any person or entity
  • To engage in any conduct that interferes with others' use of the Services or that could harm Archandles, Shopify, or other users

In addition, you agree not to:

  • Upload viruses or malicious code
  • Reproduce, copy, or exploit any portion of the Services for commercial purposes
  • Collect or track personal information of others
  • Use any robot, spider, scraper, AI tool, or automated process to access the Services, except as permitted in Section 17
  • Bypass security features or access restrictions

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine you have violated any part of these Terms.

Section 17 — Agents

This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of any person or entity and that can be executed without direct human supervision.

No Agent may access, use, or interact with the Services unless it identifies itself and operates in strict accordance with the requirements below. We may, at our discretion, request that any Agent refrain from accessing the Services, and we may use technical measures to limit how Agents interact with the Services.

Agents must:

  1. In all HTTP/HTTPS requests, identify the request as coming from an Agent and disclose the Agent's name in the user agent string in the format Agent/[agent name]
  2. Not conceal or obfuscate that interactions are coming from an Agent, including by mimicking human behavior or completing CAPTCHAs intended to distinguish human use from automated use
  3. Respond truthfully to any question or prompt seeking to determine whether interactions are from a human or a computer
  4. Not circumvent any measure intended to block, limit, or control how Agents access the Services

Section 18 — Termination

We may terminate this agreement or your access to the Services (or any part of them) at our sole discretion, at any time, without notice. You will remain liable for all amounts due up to and including the date of termination.

The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Force Majeure, Governing Law, and any other provisions that by their nature should survive.

Section 19 — Disclaimer of warranties

The information presented through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY ARCHANDLES OR REQUIRED BY APPLICABLE LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Some jurisdictions do not allow the exclusion of certain warranties, so the above exclusions may not apply to you. Nothing in these Terms is intended to exclude, restrict, or modify any consumer rights under applicable law that cannot be lawfully excluded, including rights under the Australian Consumer Law.

Section 20 — Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL ARCHANDLES, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS — OR THOSE OF SHOPIFY AND ITS AFFILIATES — BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

TO THE EXTENT THAT LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICES OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

This Section does not exclude or limit liability that cannot lawfully be excluded or limited, including under the Australian Consumer Law or applicable U.S. consumer protection laws.

Section 21 — Indemnification

You agree to indemnify, defend, and hold harmless Archandles, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — arising out of:

  1. Your breach of these Terms or any documents incorporated by reference
  2. Your violation of any law or the rights of a third party
  3. Your access to and use of the Services

We will notify you of any claim subject to indemnification. A failure to promptly notify you will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of any such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You agree to cooperate in the defense of indemnified claims.

Section 22 — Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be deemed severed from these Terms. The validity and enforceability of the remaining provisions will not be affected.

Section 23 — Waiver and entire agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies posted on the Services (including the Privacy Policy and Refund Policy), constitute the entire agreement between you and Archandles and govern your use of the Services. They supersede any prior agreements, communications, or proposals, whether oral or written, including any prior versions of these Terms.

Any ambiguities in these Terms will not be construed against the drafting party.

Section 24 — Assignment

You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent. Any such attempt will be null and void.

We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or prior notice.

Section 25 — Force majeure

We will not be liable for any failure or delay in performance under these Terms caused by events beyond our reasonable control, including but not limited to: natural disasters, fires, floods, earthquakes, acts of war, terrorism, civil unrest, government actions, pandemics, public health emergencies, labor disputes, internet or power outages, supply chain disruptions, and shipping carrier failures. In the event of such an occurrence, our obligations will be suspended for the duration of the event, and we will resume performance as soon as reasonably practicable.

Section 26 — Governing law and jurisdiction

These Terms and any separate agreements through which we provide you Services are governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law principles.

You and Archandles agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be submitted to the exclusive jurisdiction of the courts of the State of Victoria, Australia, except that:

  • Consumer protection laws of your country or state of residence may grant you additional rights that cannot be waived. Nothing in this Section limits those rights
  • Either party may seek urgent equitable relief (such as injunctions) in any court with jurisdiction

Before filing any formal legal action, you agree to first contact us at hello@archandles.com to attempt good-faith resolution. We will respond within 30 days. This informal resolution requirement does not apply to claims for urgent equitable relief.

The headings used in these Terms are included for convenience only and do not limit or otherwise affect interpretation.

You can review the most current version of these Terms at any time on this page.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes on our website. It is your responsibility to check this page periodically. We will notify you of material changes in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of the Services after the posting of any changes constitutes acceptance of those changes.
